Police Scotland acknowledges conviction of Brian Penn for causing the death of baby son
We acknowledge the conviction of Brian Penn who was yesterday, Wednesday, 19, May, 2021, convicted of causing the death of his baby son.
Kaleb Penn died in hospital in November 2017. Brian Penn, 30, Kaleb’s father, pled not guilty to the murder of the seven-week old baby at the High Court in Glasgow. He was yesterday convicted of his culpable homicide and a separate serious assault charge.
On Wednesday, 1 November 2017, the ambulance service attended at an address in Wilson Street, Ayr, following a report of an unresponsive baby. Seven week-old Kaleb was initially taken to Crosshouse Hospital and later transferred to the Queen Elizabeth University Hospital where he died on 3 November.
Following an investigation into the death, Brian Penn was arrested and charged in connection with the incident in September 2018.
Detective Chief Inspector Alan McAlpine, of the Major Investigation Team (MIT), said: “My thoughts remain with the family and friends of Kaleb after this tragic incident.
“Police Scotland welcomes this conviction and I hope this news gives Kaleb’s family some closure on what has been such a difficult time.
“Brian Penn took the life of his son and will now have to face the consequences of his actions for the rest of his life.
“I would like to thank our dedicated officers and partner agencies who worked tirelessly on this investigation.

Penn is due to be sentenced in June.
